1. Basis of Contract - Purchase of Travel Money from Gemcabin Limited t/a Vacation Money 

This internet ordering service (the "Service") is provided by Gemcabin Limited, a company incorporated in England & Wales with company number 01786166 and having our registered office at

1 Cedar Square, Blackpool, Lancashire, FY1 1BP

(“Vacation Money”) to you (the “Customer”).

These Online Terms and Conditions (the “Conditions”) apply to the Service, which consists of an online ordering facility for foreign currency banknotes (“Travel Money”) through the website www.vacationmoney.co.uk (the “Website”). For the avoidance of doubt, the Conditions do not apply to any orders for Travel Money placed in a Vacation Money branch.

An order (“Order”) placed with Vacation Money constitutes an offer by you to purchase Travel Money through the Service in accordance with these Conditions.

The Order shall only be deemed to have been accepted when e-mail confirmation is sent by Vacation Money to the Customer at which point the contract (the “Contract”) between Vacation Money and the Customer will be deemed to have come into existence.

The Contract constitutes the entire agreement between Vacation Money and the Customer. The Customer acknowledges that it has not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of Vacation Money which is not set out in the Conditions.

2. Use of the Service

The Service is only available to Customers aged 18 years or over, and who reside in and access the Service from the United Kingdom. By ordering Travel Money from us, you confirm that you have read and understood the Conditions and agree to be bound by them and to comply with all applicable laws and regulations.

3. Making an Order

Use the ordering service to click and collect from a branch near to you.

You can contact your local branch to make arrangements for large or specific orders, by simply using the Store Finder link on the website for contact details.

Currency availability may also be subject to further monetary limits, currency exchange restrictions and to customers complying with all applicable laws and regulations, including those relating to anti-money laundering regulations.

4. Charges and Payment

All Orders must be fully paid in pounds sterling upon collection, either by cash or accepted Debit cards.

The amount payable by the Customer to Vacation Money will be calculated in accordance with the rates available on the Website. The exchange rates quoted by Vacation Money are subject to change and these may vary from the rates provided in branches owned or operated by or on behalf of Vacation Money. Vacation Money will use the exchange rate (as set by Vacation Money) that appears on the ordering screen at the time they receive the Customer’s Order.

5. Placing an order

You can place an Order up to 5 days in advance of the collection date. The availability and restrictions on collection are as follows:

If your order contains any currency in addition to Euros or US Dollars your collection date will automatically be that of the other currency for the complete order.

6. All Orders

You must provide the information requested by Vacation Money to allow us to process your Order. Vacation Money reserve the right to request further information from you at any time to enable us to complete your Order and/or to comply with any regulatory requirements.

Vacation Money will use various procedures to authenticate each transaction and may, at any time, decline to process your Order or any part of your Order for any reason. By placing an Order, you confirm that the details contained in the Order are correct in all respects. A confirmation screen will be displayed once you have placed your Order. This will set out the details of your Order and will confirm receipt of your Order only. Your Order will not be accepted by Vacation Money until you are in receipt of an email confirmation from Vacation Money in accordance with Condition 1.

7. Collecting Your Travel Money

Orders can be collected from the Vacation Money location selected during the ordering process. Collection is subject to the opening times of the selected branch. Details for the opening times of the collection location can be obtained on our website.

At the time of collection, payments being made by card mean the cardholder must produce for identification purposes either:

1. a valid passport; or

2. a valid UK Photographic Driving Licence.

Vacation Money reserves the right to request further information and identification (such as proof of residential address) in accordance with anti-money laundering legislation and/or Vacation Money policies from time to time.

In order to enable Vacation Money to comply with its anti-money laundering and/or other legal obligations and its internal risk and fraud policies, Vacation Money reserves the right to take a copy of the cardholder’s identification document(s) and the card used to make the purchase, at the time of collection.

8. Your Personal Data

In accordance with Data Protection legislation, sensitive information will be rendered illegible on any copy taken, and retained, of any debit card in accordance with Condition 8.

Vacation Money will use the information that we collect about you to provide the Service to you. This may require a personal data check in respect of Money Laundering regulations.

Vacation Money will never pass any personal information relating to a Customer to anyone else, except where we are required or permitted to do so by law, for any successors in title to our business and suppliers that process information on our behalf both in the UK and abroad.

9. Your Right to Cancel

If you placed an Order for collection this Order can be cancelled within 1 hour of processing the order by emailing: orders@vacationmoney.co.uk or by contacting your collecting branch.

10. Our Right to Cancel

Vacation Money reserves the right to cancel the Order at any time. If the cancellation is a result of Vacation Moneys’error, no fees are payable by the Customer.

11. Failure to Collect

If you fail to collect you’re Order from your selected Vacation Money location within 4 days of the collection date then your Order will be marked as “not-collected” and MAY be cancelled at the sole discretion of Vacation Money. Not-Collected Orders may still be available for collection for a certain time, but the rate on the day at time of collection will be used for the currency purchase, not the originally quoted rate.

12. Corrections and Complaints

If you need to make any changes to your Order please contact the branch you have ordered from and they will be happy to assist you as best they can. Use the Store Finder for contact details for each store.

Further Complaints

We will always try our best to resolve any complaint. However, if you have already contacted us and we have not been able to resolve your complaint in a satisfactory manner, you also have the option to use the European Online Dispute Resolution platform to have your complaint handled by an alternative dispute resolution body. 13. Limitation of Liability

Vacation Money does not make any representation or give any warranty in respect of the Website or its content. In particular, Vacation Money does not give any warranty as to the accuracy, suitability, reliability, completeness, performance, fitness, freedom from viruses or timeliness of the content or services contained on the Website. Moreover, but without limiting the exclusion, the information services on the Website are intended for use by holiday or business travellers or by individuals or companies seeking to make payments abroad in foreign currencies, and should not be used for speculation or investment. These information services and other content of the Website are not intended to amount to advice on which reliance should be placed. Vacation Money accepts no responsibility or liability arising from any reliance placed on such services by any visitor to the Website or by anyone who may be informed of any of its contents. Vacation Money use reasonable care and skill in providing the Service. However, Vacation Money shall not be liable to any Customer for the following:

1. any failure by a Customer to provide Vacation Money with correct information when an Order is placed;

2. any failure on the part of Royal Mail or any other carrier we use to send a Customer’s Order or deliver an Order on time to the selected branch;

3. if Vacation Money is unable to perform any of its obligations to a Customer due to failure of any technical systems or for any other reasons beyond its reasonable control including, without limitation, war, terrorism, government action, natural disaster, and industrial dispute;

4. any damage to a Customer’s computer equipment as a result of using the Website or the Service;

5. any loss of information or unauthorised use of data arising as a result of a Customer using encryption systems below Vacation Money’s recommended level; or

6. any indirect, or consequential losses, claims or damages suffered by any Customer or incurred from a Customer’s use or delay or inability to use the Website or the Service however caused.

Vacation Money’s maximum liability to any Customer in respect of each use of the Service for any Order shall be to refund the purchase price of that Order. The disclaimers and limitations of liability in these Conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Vacation Money or any of its employees or agents or for fraud. If any provisions of these Conditions, including any disclaimers and limitations, is found to be unlawful or unenforceable then such provisions shall fall away and shall not affect the validity and enforceability of the remaining terms. This does not affect your statutory rights.

15. Alteration of Terms

Vacation Money may, at any time, with immediate effect, in respect of future Orders, change, suspend or withdraw the Website, the Service and these Conditions without notice and without liability to any Customer. If we revise the Conditions, we will post the revised version on the Website. You are expected to check our Conditions from time to time to take notice of any changes we make, as they are binding on you. By using the Website or the Service or by placing Orders after we have changed these terms, you will be accepting the changes.

16. Law and Jurisdiction

The relationship between Vacation Money and any Customer shall be governed and interpreted in accordance with English Law. Vacation Money and each Customer irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Conditions, any Order placed and/or any Service provided (including non-contractual disputes or claims).

17. Intellectual Property

Nothing in these Conditions gives the Customer any license to use any trademarks or service marks owned by or used by Vacation Money.

18. General

Vacation Money may transfer its rights under these Conditions to another business where it reasonably believes the Customer’s rights will not be affected.

If you breach these Conditions and we choose to ignore this, we will not be prevented from using our rights and remedies at a later date or in any other situation where you breach these Conditions. We shall not be responsible for any breach of these Conditions caused by circumstances beyond our reasonable control.
